The Kaduna State New Nigeria People’s Party (NNPP) has dragged the Independent National Electoral Commission (INEC) to court, praying for the disqualification of the All Progressive Congress (APC) Governorship Candidate, Senator Uba Sani over alleged electoral irregularities in the primary election held on May 27, 2022.

The NNPP alleged that the candidates list published by INEC on July 22, for the General Election, did not emerge through a legal process or due process as prescribed by the Electoral Act and other extant laws.
The party, is therefore, asking the court to compel INEC to do the right thing by removing the candidates of the APC from the list of eligible candidates for the 2023 General Elections in Kaduna State.

The NNPP Lead counsel, Wole Agunbiade, SAN, had told the court that he was yet to be served by INEC. On his part, APC Lead Counsel, Sule Shuaibu said he was served, adding however, that he needed more time to process all the documents and thereafter appealed for time to file his motions.
Counsel to INEC, Halima Gachi, had earlier told the court that she was not certain that all the parties were served, explaining that she took over the case from her colleague in the office. The case which came up for mention in Kaduna on Friday, was adjourned to Sept. 15 for hearing.

When the case came up for mention on Friday before Justice Hadiza R. Shagari of the Federal High Court, Kaduna, all the parties sought for extension of time to enable them prepare and respond to the motion on service accordingly.

Justice Shagari therefore adjourned the case to September 15 for hearing.

APC was led by Barrister Sule Shuaibu while INEC counsel was Barrister Halima Gachi.

However, speaking to Reporters through one of his legal team shortly after the Court sitting, Wole Agunbiade, said, “We want to ensure that INEC does the right thing. INEC shouldn’t have published the name of the candidate because APC did not conduct valid primary election. The court should compel INEC to do the right thing”.

“NNPP is challenging the conduct of APC primary election for governorship held on May 27, 2022. APC adopted direct primary where all the wards Congress must be conducted but instead the party selected few delegates to conduct the election. They violated the rules of direct primary. They adopted consensus and so the delegates are not known to the law”

Recalled that Senator Uba Sani was declared winner of the Governorship primary election of the All Progressives Congress( APC) in Kaduna state.

He was declared winner at about 2. am on Friday, May 27, 2022 at the Umaru Musa Yar’Adua Hall ,Murtala Square Kaduna where he defeated two other aspirants in the contest.

Uba Sani polled 1, 149 votes to emerge while a former Assistant Controller General (ACG) of Customs, Bashir Abubakar scored 37 votes and Alhaji Mahmood Sani Shaaban polled ten votes .

1, 245 delegates were accredited, total votes cast, 1,235, valid votes , 1,196 while invalid votes were 39.
